Welcome to StrongHER by AFJ. These Terms of Use ("Terms") govern your access to and use of the StrongHER by AFJ mobile application (the "App") operated by StrongHER Nutrition LLC ("we," "us," "our"), a California limited liability company.
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

I. Acceptance of Terms
By accessing or using StrongHER by AFJ, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy (available at https://www.stronghernutrition.com/privacy), and any additional guidelines or rules referenced herein. These Terms constitute a legally binding agreement between you and StrongHER Nutrition LLC.

II. Eligibility
You must be at least **18 years of age** to create an account and use StrongHER by AFJ. By using the App, you represent and warrant that you are at least 18 years old. We verify your age during account setup. If we determine that a user is under 18, we will terminate their account and delete all associated data.

III. Account Registration
To use StrongHER by AFJ, you must create an account using a valid email address. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

IV. Subscription and Payments
StrongHER by AFJ is a subscription-based service. Access to the App's features requires an active paid subscription.
- **Pricing:** Subscription plans and pricing are displayed within the App. We offer a Founding Member plan (limited to the first 100 subscribers) and a standard monthly plan.
- **Payment:** All payments are processed through Apple's In-App Purchase system. We do not collect or store your payment card information.
- **Auto-Renewal:** Subscriptions automatically renew at the end of each billing period unless you cancel. You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
- **Refunds:** Refund requests are handled by Apple in accordance with their refund policies. Contact Apple Support for refund inquiries.
- **Promo Codes:** We may offer promotional codes that provide free access for a specified period. Promo codes are subject to their own terms and expiration dates as communicated at the time of issuance.

V. Fitness, Nutrition, and Health Disclaimer
StrongHER by AFJ provides general fitness, nutrition, and wellness information and tools for educational and informational purposes only. **We are not medical professionals, licensed dietitians, or certified nutritionists.**
By using the App, you acknowledge and agree that:
- The macro calculations, nutrition information, food database, meal logging, and workout tracking provided are general tools and are not tailored medical or dietary advice
- You should consult a qualified healthcare provider, registered dietitian, or physician before starting any new diet, exercise program, or nutrition plan, particularly if you have any medical conditions, eating disorders, or health concerns
- Individual results vary based on numerous factors including genetics, consistency, medical conditions, and other variables beyond our control
- We do not guarantee any specific results from using the App
- You assume all risk associated with any dietary or exercise changes you make based on information in the App
- The food database contains nutritional information that, while carefully curated, may contain inaccuracies. Always verify critical nutritional information with product labels or authoritative sources

VI. AI Assistant (Sora)
StrongHER by AFJ includes an artificial intelligence (AI) assistant called "Sora" designed to provide general wellness support, encouragement, and motivational guidance. By using Sora, you acknowledge and agree to the following:
a) Sora is not a healthcare provider.** Sora is not a therapist, counselor, psychologist, psychiatrist, doctor, dietitian, or any other licensed medical or mental health professional. Sora does not provide medical advice, diagnoses, or treatment recommendations. Nothing Sora says should be interpreted as professional medical or mental health care.
b) AI-generated content.** Sora's responses are generated by a third-party artificial intelligence model (Anthropic's Claude). Responses may be inaccurate, incomplete, or inappropriate for your specific circumstances. You should not rely solely on Sora's responses for any health-related decisions.
c) Not a substitute for professional care.** If you are experiencing a medical or mental health emergency, please contact emergency services (911), the 988 Suicide & Crisis Lifeline (call or text 988), or the Alliance for Eating Disorders Helpline (1-866-662-1235). Sora is not equipped to handle medical emergencies.
d) Data processing.** Your messages to Sora are processed by Anthropic's Claude API to generate responses. By using Sora, you consent to this processing. Your conversations are stored securely in our database. Anthropic does not retain your messages after processing per their API data usage policy. For more information, see our Privacy Policy.
e) Limitation of liability.** To the maximum extent permitted by law, StrongHER Nutrition LLC shall not be liable for any actions taken or not taken based on Sora's responses, including but not limited to changes to diet, exercise, or health-related behaviors. Your use of Sora is entirely at your own risk.
f) Age requirement.** Sora is available only to users aged 18 and older, consistent with the general age requirement for StrongHER by AFJ.

VII. Mood Tracking and Wellness Disclaimer
StrongHER by AFJ includes mood tracking, binge/urge logging, and wellness reflection features. These tools are designed to help you track patterns and reflect on your journey. They are **not** clinical assessments, diagnostic tools, or therapeutic interventions.
- We are not mental health professionals and do not provide mental health treatment
- Mood and binge/urge tracking is for your personal reflection only
- If you are struggling with an eating disorder, mental health condition, or emotional crisis, please seek help from a licensed mental health professional
- The National Eating Disorders Association (now the Alliance for Eating Disorders) helpline is available at 1-866-662-1235

VIII. Supplement Disclaimer
StrongHER Nutrition LLC may offer or reference nutritional supplements. Any supplements mentioned or sold are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration (FDA). Consult your healthcare provider before using any dietary supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.

IX. User Accounts and Conduct
You agree to use StrongHER by AFJ in compliance with all applicable laws and these Terms. You agree not to:
- Create an account if you are under 18 years of age
- Impersonate any person or entity or misrepresent your affiliation
- Use the App for any illegal, harmful, or unauthorized purpose
- Harass, bully, threaten, or intimidate other users
- Post content that is defamatory, obscene, hateful, discriminatory, or promotes violence
- Post pro-eating-disorder content, self-harm content, or content that encourages disordered eating behaviors
- Post sexually explicit content or content involving minors
- Spam, send unsolicited messages, or use automated systems to access the App
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the App's functionality or security
- Reverse-engineer, decompile, or attempt to extract the source code of the App
- Use the App to collect personal information about other users without their consent
We reserve the right to suspend or terminate your account, remove content, and take any other action we deem appropriate if you violate these Terms or our Community Guidelines.

X. User-Generated Content
StrongHER by AFJ allows you to post content including text, photos, and videos to the community feed, journal, comments, and direct messages ("User Content").
**Ownership:** You retain ownership of the User Content you create. By posting User Content to the App, you grant StrongHER Nutrition LLC a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely in connection with operating and promoting the App. This license ends when you delete your User Content or your account.
**Prohibited Content:** You may not post User Content that violates Section IX of these Terms. We reserve the right to remove any User Content that violates these Terms, our Community Guidelines, or applicable law, at our sole discretion and without prior notice.
**Reporting:** If you encounter content that violates these Terms, you may report it through the in-app reporting feature. We review all reports and take action as we deem appropriate.
**No Guarantee of Storage:** While we make reasonable efforts to maintain your User Content, we do not guarantee permanent storage. You are responsible for maintaining your own copies of important content.

XI. Account Deletion
You may delete your account at any time directly within the App by navigating to Settings > Delete Account. You may also request account deletion by contacting us at [email protected].
Upon account deletion, your personal data will be permanently removed in accordance with our Privacy Policy, including all posts, journal entries, messages, nutrition data, workout data, AI conversations, and uploaded media. Deletion is processed within 30 days.
Some data may be retained where required by law (e.g., transaction records for tax/accounting purposes).

XII. Intellectual Property
The App, including its design, code, features, branding, logos, text, graphics, and all other content created by StrongHER Nutrition LLC, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App or its content without our express written permission.
"StrongHER by AFJ" and "StrongHER Nutrition" are trademarks of StrongHER Nutrition LLC.

XIII. Third-Party Services
StrongHER by AFJ integrates with third-party services to provide its features (see our Privacy Policy for details). We are not responsible for the availability, accuracy, content, or privacy practices of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

XIV. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE APP, INCLUDING NUTRITIONAL DATA, MACRO CALCULATIONS, AND AI-GENERATED CONTENT.

XV. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STRONGHER NUTRITION LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:
- PHYSICAL INJURY, ILLNESS, OR ADVERSE HEALTH EFFECTS
- LOSS OF DATA OR CONTENT
- RELIANCE ON INFORMATION PROVIDED BY THE APP OR SORA AI
- ACTIONS OF OTHER USERS
- SERVICE INTERRUPTIONS OR ERRORS
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

XVI. Indemnification
You agree to indemnify, defend, and hold harmless StrongHER Nutrition LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the App
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable law or regulation

XVII. Dispute Resolution and Arbitration
**Binding Arbitration:** Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures.
**Class Action Waiver:** YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
**Small Claims Exception:** Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
**Opt-Out:** You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of creating your account. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.
**Arbitration Fees:** StrongHER Nutrition LLC will pay all arbitration filing fees and arbitrator costs for claims under $10,000. For claims over $10,000, fees will be allocated according to JAMS rules.
**Governing Law:** These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

XVIII. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by email at least 30 days before the changes take effect. Your continued use of the App after the effective date of any modifications constitutes your acceptance of the updated Terms.
If you do not agree with the modified Terms, you must stop using the App and delete your account before the effective date.

XIX. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms or our Community Guidelines
- Fraudulent or illegal activity
- Extended inactivity
- At your request (account deletion)
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections XIV through XVIII.

XX. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

XXI. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and StrongHER Nutrition LLC regarding your use of the App and supersede all prior agreements and understandings.

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer rights notice: The App is provided by StrongHER Nutrition LLC, Rancho Cucamonga, California.
